Home » About H&P
Herrera and Partners (H&P) is a Bangkok based law firm representing individuals who face extradition requests, Interpol notices, deportation orders and international criminal proceedings in Thailand. We act for foreign nationals and Thai citizens whose liberty depends on how the first few days of a case are handled.
Extradition in Thailand is decided through the courts, not through an administrative process. That means the outcome turns on legal argument, evidence and procedure. Our team combines Thai licensed attorneys with foreign legal consultants so that clients understand every stage of the case in a language they speak, and so that the defence strategy accounts for both Thai law and the law of the requesting country.
Herrera and Partners is a full service law firm headquartered in Bangkok with practice areas covering criminal law, litigation and dispute resolution, corporate and commercial law. This website is dedicated to one of our most demanding practice areas: extradition and international criminal matters in Thailand.
Our clients include foreign nationals arrested in Thailand, families acting on behalf of a detained relative, embassies and diplomatic missions, corporations facing cross border investigations, and lawyers abroad who need local counsel in Bangkok.
Extradition defence. Opposing extradition requests before the Criminal Court in Bangkok, challenging dual criminality, the sufficiency of the evidence submitted by the requesting state, and the political or military offence exceptions under the Extradition Act.
Interpol notices. Advising clients subject to Red Notices and diffusions, including representations relating to the notice and its effect on travel, residence and immigration status in Thailand.
Deportation and immigration detention. Acting where a foreign government pursues removal through immigration channels rather than through a formal extradition request.
Arrest and detention assistance. Attending police stations, arranging interpreters, applying for bail and visiting clients held in prisons and immigration detention centres.
Coordination with counsel abroad. Working alongside the client’s lawyers in the requesting country so that the defence in Thailand and the defence overseas are consistent.
The first question in any extradition matter is whether a treaty exists between Thailand and the requesting state, and whether the request satisfies the requirements of the Extradition Act. Requests are frequently incomplete, late or built on an offence that is not recognised as a crime under Thai law. We examine the file before anything is conceded.
